In copyright law there is a doctrine known as "fair use" which permits the use of copyrighted materials without the permission or compensation of the owner. I believe Huckabee's use of the song in this context falls within the fair use doctrine and Tom would find himself legally unable to restrain him from playing it in this fashion.
